VOLUNTEER AGREEMENT, LIABILITY WAIVER, PHOTOGRAPHY RELEASE, AND NON-DISCLOSURE AGREEMENT

This Volunteer Agreement ("Agreement") is made and entered into as of the date of signature, by and between the Japanese Cultural Exposition Group ("Organization") and the undersigned volunteer ("Volunteer"). By signing this Agreement, the Volunteer agrees to the following terms and conditions:

1. GENERAL TERMS OF VOLUNTEER SERVICE

1.1. The Volunteer agrees to perform assigned duties at AniFest 2025 to the best of their abilities in a professional and responsible manner.

1.2. The Volunteer understands that this is an unpaid position and does not entitle them to wages, compensation, or benefits of any kind.

1.3. The Organization reserves the right to terminate a Volunteer’s service at any time for any reason, including but not limited to misconduct, failure to follow instructions, or behavior that is disruptive or unsafe.

1.4. The Volunteer agrees to be punctual and reliable, arriving at the designated times and locations as scheduled.

1.5. The Volunteer must wear the required attire or uniform, if applicable, and maintain a neat and professional appearance.

1.6. The Volunteer agrees to treat all attendees, staff, and fellow volunteers with courtesy and respect at all times.

1.7. The Volunteer agrees to follow all safety guidelines and emergency procedures as outlined by the Organization.

1.8. The Volunteer agrees not to consume alcohol, illegal substances, or be under the influence of any impairing substances while volunteering.

1.9. The Volunteer agrees to communicate any schedule conflicts or personal emergencies to the Organization as soon as possible.

1.10. The Volunteer agrees to refrain from using personal devices excessively during volunteer hours unless required for their assigned tasks.

1.11. The Volunteer acknowledges that their assigned tasks may involve physical activity such as lifting, walking, standing for extended periods, or exposure to crowded environments.

1.12. The Volunteer understands that any materials, tools, or resources provided by the Organization remain the property of the Organization and must be returned at the end of service.

1.13. The Volunteer agrees to handle sensitive information, money, or merchandise responsibly if assigned such duties.

2. GENERAL LIABILITY WAIVER AND RELEASE

2.1. The Volunteer acknowledges that participation in AniFest 2025 involves inherent risks, including but not limited to physical activity, interaction with event attendees, and potential exposure to hazards.

2.2. The Volunteer agrees to release, indemnify, and hold harmless the Japanese Cultural Exposition Group, its officers, directors, employees, agents, sponsors, partners, and affiliates from any and all liability, claims, demands, damages, or causes of action arising from their participation in AniFest 2025.

2.3. The Volunteer acknowledges that they are voluntarily assuming all risks associated with participating in the event and agrees not to hold the Organization liable for any injuries, illness, loss, or damage to personal property.

2.4. The Volunteer certifies that they are physically fit to participate and have no medical conditions that would prevent them from safely performing assigned duties.

2.5. The Volunteer consents to emergency medical treatment in case of injury or illness while volunteering and agrees that the Organization is not responsible for any related medical expenses.

2.6. The Volunteer acknowledges that the Organization does not provide insurance coverage for volunteers and that it is their responsibility to obtain personal insurance if desired.

2.7. The Volunteer agrees to indemnify and hold harmless the Organization from any claims made against it as a result of the Volunteer’s own actions or negligence.

2.8. The Volunteer acknowledges that they are responsible for securing their own belongings and that the Organization is not liable for any lost, stolen, or damaged personal items.

2.9. The Volunteer agrees that the Organization is not responsible for cancellations or modifications to the event due to circumstances beyond its control, including but not limited to weather conditions, public health concerns, or government actions.

3. PHOTOGRAPHY AND MEDIA RELEASE

3.1. The Volunteer grants the Organization the irrevocable right and permission to take, use, reproduce, and publish photographs, video recordings, or audio recordings in which they may appear.

3.2. Such materials may be used for promotional, educational, or commercial purposes in any media format (print, online, social media, television, etc.) without further compensation.

3.3. The Volunteer waives any right to inspect or approve the final product and releases the Organization from any claims related to the use of their likeness.

4. NON-DISCLOSURE AND CONFIDENTIALITY AGREEMENT

4.1. The Volunteer acknowledges that they may be exposed to confidential or proprietary information, including but not limited to:

  • Internal event planning documents
  • Vendor and sponsor contracts
  • Financial records and budgeting details
  • Guest lists and personal contact information
  • Security protocols and incident reports
  • Marketing strategies and promotional materials before public release
  • Private communications with partners, vendors, or high-profile guests
  • Other sensitive operational details

4.2. The Volunteer agrees not to disclose, reproduce, or distribute any confidential information without express written permission from the Organization.

4.3. The Volunteer agrees to use confidential information solely for the purpose of fulfilling their volunteer duties and not for personal or third-party gain.

4.4. Upon termination of volunteer service, the Volunteer agrees to return or securely dispose of any materials containing confidential information.

4.5. The Volunteer acknowledges that breach of this section may result in legal action and/or removal from all future volunteer opportunities.

4.6. This section shall survive the termination of the Volunteer’s service.

5. CODE OF CONDUCT

5.1. The Volunteer agrees to conduct themselves in a respectful and professional manner at all times.

5.2. The Volunteer must:

  • Treat all attendees, staff, vendors, and other volunteers with courtesy and respect.
  • Adhere to all event rules and regulations.
  • Follow the instructions given by event organizers and supervisors.
  • Maintain a positive and welcoming attitude.
  • Avoid any form of discrimination, harassment, or offensive behavior.
  • Act in a manner that reflects positively on the Organization.

5.3. The Volunteer must not:

  • Engage in inappropriate physical contact, offensive language, or disruptive behavior.
  • Participate in any illegal activity while representing the Organization.
  • Use the event or volunteer position for personal gain or self-promotion.
  • Bring unauthorized guests or pets into restricted volunteer areas.
  • Remove event property, merchandise, or supplies without permission.

5.4. Harassment, discrimination, violence, or any inappropriate behavior towards attendees, staff, or other volunteers will result in immediate dismissal.

5.5. The Volunteer agrees to report any misconduct or violations of this agreement to their designated supervisor.

6. GOVERNING LAW AND SEVERABILITY

6.1. This Agreement shall be governed by and construed in accordance with the laws of the State of California.

6.2. If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

7. ACKNOWLEDGMENT AND SIGNATURE

By signing below, I acknowledge that I have read, understood, and voluntarily agree to the terms of this Agreement. I affirm that I am 18 years of age or older, or have obtained parental/guardian consent if under 18.
